NOTICE TO USER: BY SUBMITTING YOUR APPLICATION TO BECOME A DEALER OF ROJICO PRODUCTS, YOU ACKNOWLEDGE AND ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.
1. Definitions
"We" or "us" means the employees at Rojico Trading Company and all it holds. "You" means a) the perspective
buyer filling out the registration for buying status and b) the approved buyers who have been accepted
by Rojico. "Rojico", "Rojico.com", "Rojico Trading", or "Rojico Trading Co." means Rojico Trading Company, located at 2841 Unicorn Road, Bakersfield, California 93308.
2. Dealer Representation:
RoJico sells to
approved trade buyers only. Buyer accounts are openly welcomed and generally approved upon submission. By using this site, all users agree to be truthful in the information they disclose
on the registration. Unauthorized non-trade use is prohibited. RoJico reserves the right to determine the appropriateness of any
buyer to purchase or represent our products.
3. User Agreement:
The use of this site is at the sole discretion of RoJico and use
by any specific buyer may be terminated by the company at any time, with or
without cause. The password provided to our buyers for access to the exclusive portions of this site is intended only for our
approved buyers and may not be disclosed to others for use without written consent from RoJico.
Buyers allowing clients direct access to this site are subject to immediate termination. Guard your access codes! In the event you provide others with your login and password information, you agree to be
financially liable for any and all orders placed using your access codes.
4. Your Information
On the buyer registration, you are required to submit all required fields about you or your business. Failure to include all necessary information could result in a denied
of your registration. Rojico Trading Company does not share your submitted information with any other company.
You must also submit, via fax to 661-616-4019, a copy of your Reseller's Permit, and generally one or two other forms of proof of your business.
5. Specifications, Terms and Prices:
The sizes, textures and
colors of the various products on the RoJico website are approximate and may
vary. Specifications, terms, and prices are subject to change without notice
when Rojico updates to this site.
6. Ordering Requirements:
There is no minimum order requirement other than all orders for less than
$200 will have a $5.00 drop-ship charge assessed over and above the actual
shipping costs. Buyers may have their login/password terminated if there is no
activity on their account for a period of six (6) consecutive months.
7. Terms of Payment:
Payment may be provided in the form of check, money order, or by major credit card
held on file. Pre-payment for all standard orders is required before the shipment of goods, except in cases where credit
may be extended by RoJico (available only to Tier 3-5 only) by mutual agreement. For custom orders, RoJico requires a 50% payment upon
processing of the order with the 50% balance due when ready for shipping. Custom order deposits are non-refundable and cancellation after any custom order is started will result in the forfeiture of said deposit. RoJico reserves the right to extend credit to
approved buyers in Tiers 3-5, with terms of the credit being determined by individual
agreement.
8. Buyer Termination
RoJico reserves the right to terminate or
block any buyer status at any time, with or without cause.
9. Overdue Accounts:
The dealer agrees to pay all costs that are associated with the collecting of a dealer's overdue account. If a dealer foresees being unable to make payments by their due date, it is the dealer's responsibility to contact RoJico to set up an alternative payment plan that must be approved by RoJico.
10. Freight Charges:
All pricing is listed FOB our Bakersfield, CA warehouse.
Actual freight charges will apply as an additional cost on all orders. The exact freight charge will be billed to the dealer upon shipment of an order. See RoJico's Shipping Information for more details regarding our shipping policy.
11. Damaged Items:
The Architectural Decor products that are sold to buyers by RoJico are primarily
polyurethane, and are very durable. Occasionally in shipping, crates or packaging may be damaged, but the product inside, because of it's physical properties, will be totally fine. Do not reject a package solely on the outside appearance
of the packaging, but clearly notate on acceptance of delivery any damages to the shipping materials. Most shipments are of multiple items, so in case of freight damage only a few of the items may be damaged and need to be replaced. Accept the shipment, take photos of any damaged items and submit to sales@rojico.com within 5 business days for
prompt replacement. For mouldings, a cracked or damaged end of a piece will be
credited in proportion to the total length, and such damage does not constitute
reason for rejection or full replacement of a moulding.
12. Returns:
Returned goods will not be accepted, nor will credit be granted for any returned goods unless prior written permission from RoJico is obtained by contacting RoJico at
returns@rojico.com or 877-550-0600. Authorization for returning products will only be granted within 30 days of the dealer's receipt of the goods. The dealer is responsible for all return shipping charges as well as the original shipping charges. The dealer is responsible for returning goods in the condition in that they were originally received. Returns, other than those due manufacturing defects or damage during shipment, are subject to a
15% restocking fee. There will be a 25% restocking fee for any custom or special
order item.
13. Intellectual Property:
All designs and images appearing on RoJico's website are copyrighted by RoJico. All rights are reserved and may not be reproduced, duplicated or otherwise used without express written permission from RoJico.
14. Legal
Buyers agree that any and all legal disputes or cause of actions are to be in
the jurisdiction of RoJico's headquarters in Bakersfield. CA.
15. Modification:
These Terms and Conditions are subject to modification by RoJico at any time without prior notice and shall be effective upon RoJico's publication of the revised Terms and Conditions on its Website at www.rojico.com.
